What Texas law says

The law protects the injured person, not the paperwork

Whether you call yourself undocumented, “illegal,” out of status, on DACA or TPS, or you simply don't have papers, the answer is the same: if someone else caused your injury in Texas, you can pursue compensation for it. The law asks who caused the harm, not where the injured person was born.

In TXI Transportation v. Hughes (2010), the Texas Supreme Court threw out a verdict because the jury heard about a driver's immigration status, holding that it had nothing to do with who caused the crash. In Grocers Supply v. Cabello (2012), a Texas court of appeals held that an undocumented worker could recover lost wages and lost earning capacity.

I'm here illegally. Do I still have rights after an accident?
Yes. If someone else caused your injury in Texas, you can pursue compensation for medical bills, lost wages and pain, the same as anyone else. Your immigration status does not decide the claim.
I don't have papers. Will the insurance company still pay me?
The at-fault driver's insurance owes you for the harm their driver caused, whatever your status. Adjusters sometimes ask about papers; you don't have to answer, and once you have a lawyer those calls come to us.
I'm on DACA or TPS, or my visa expired. Can I still file a claim?

Do I need a Social Security number to make a claim?
No. You can make an injury claim without a Social Security number. If you have an ITIN, bring it, but you don't need one to call us. The full answer.
Will you report me to immigration?
No. We are not immigration authorities and we do not report to them. What you tell your lawyer is confidential, and it stays that way even if you don't hire us.
I was paid in cash. Can I still recover lost wages?
Yes. Texas courts have allowed undocumented workers to recover lost wages. Pay stubs help, but so do bank deposits, messages with your boss, coworkers who know your schedule and your own records. The full answer.
