What makes a Houston case a Houston case

The law is the same across Texas. How a claim actually runs here is not.

The 90-day trap most people never hear about

If a City of Houston vehicle was involved, a city employee was working, or a dangerous condition the city was responsible for caused your injury, the two-year lawsuit deadline is not your real deadline. The city charter requires written, notarized notice within 90 days, delivered to the City Secretary.

The State of Texas allows six months. Metro, Harris County, and the school districts each have their own rules. Ninety days disappears quickly when you are still in treatment, and once it passes the claim is generally gone no matter how strong it was.

Which agency worked your crash — and why it matters

Houston's geography means the responding agency varies. Houston PD covers crashes inside the city. DPS frequently works the freeways — I-10, the 610 Loop, I-45, 59/69, the Beltway. Harris County Sheriff's deputies and constables cover unincorporated areas, and Fort Bend, Montgomery and Brazoria counties have their own. Metro has its own police for transit incidents.

Get the agency name and report number before you leave the scene. Requesting the report from the wrong agency costs days you may not have, and Texas crash reports generally take about ten days to become available.

Where a Houston case actually gets filed

Most Harris County injury suits are filed with the District Clerk at the civil courthouse at 201 Caroline downtown. Which court you draw affects the pace of the case and how the court handles scheduling and mediation — something worth knowing about your own case before anyone files anything.

The roads here produce specific crashes

Heavy commercial truck traffic runs the Ship Channel and the industrial corridors out toward Baytown, Pasadena and Channelview, which means a disproportionate share of 18-wheeler cases governed by federal motor carrier rules and evidence that disappears in days. Congested freeway stretches produce chain-reaction rear-end collisions where fault gets spread across several drivers.

And flooding. An underpass here goes from passable to deadly in minutes, and cases involving standing water, a missing barricade, a dark stretch of road or a signal that was out turn on proving the hazard existed that day. Photograph it immediately; conditions change and the proof goes with them.

Getting treated

The Texas Medical Center means specialist care is genuinely accessible here, which matters for a serious injury. If cost is the obstacle, PIP on your own auto policy pays regardless of fault, and many Houston providers will treat on a letter of protection and wait to be paid out of the settlement. Do not skip care over a bill.
