Channelview is not in the City of Houston — and that changes your deadline

This catches people constantly. Channelview is an unincorporated community in Harris County, about fifteen miles east of downtown. It is not inside Houston city limits.

That matters for one very practical reason. If a government vehicle or a dangerous road condition contributed to your crash, the City of Houston's rule requiring notarized written notice within 90 days is the deadline everyone warns you about — and it does not apply in Channelview, because the City is not the responsible entity. Harris County and the State of Texas have their own requirements, on their own clocks.

A lawyer who assumes the Houston rule applies everywhere in the region will either panic you about a deadline that is not yours, or miss the one that is. Either way you want that question answered properly in the first week.

Law enforcement follows the same logic: crashes here are typically worked by the Harris County Sheriff's Office, with DPS handling much of I-10. Request the report from the wrong agency and you lose days.

Why the trucks here are different

Channelview sits in the middle of the petrochemical corridor. The traffic is not passing through — it is tankers, flatbeds and container haulers servicing plants and terminals along the Ship Channel, running I-10 and the surface roads at all hours.

A commercial truck crash is not an ordinary car wreck with a bigger vehicle. It is governed by the Federal Motor Carrier Safety Regulations, which means questions that are usually arguments become questions with documented answers: was the driver legally able to be at the wheel under the hours-of-service limits, what do the electronic logs show, what is in the driver qualification file, was the reported maintenance defect ever fixed.

But that evidence is on a clock. Duty status records must be kept a minimum of six months. Dashcam footage is frequently overwritten within days. The engine control module — which records speed and braking in the seconds before impact — can be lost the moment the tractor is repaired or sold. Serious carriers send investigators to the scene the same day. The injured family usually calls a lawyer weeks later.

A preservation letter has to reach the carrier while that material still exists. That is the single strongest argument for making one phone call early, even while you are still in treatment.

The same corridor produces industrial injuries. Texas is the only state that does not require most private employers to carry workers' compensation.
