A neighborhood that walks, bikes and goes out at night

Montrose is one of the few parts of Houston where people routinely walk to dinner, bike to work and take a rideshare home. That changes the kinds of crashes that happen here. Pedestrians hit crossing Westheimer or Montrose Boulevard, cyclists hit by turning cars, and late-night crashes involving drivers who had been drinking are a regular part of the picture here.

Each of those has its own rules. A driver who hit you after being served past the point of obvious intoxication may not be the only one responsible: a bar or restaurant that kept serving can be liable under the Texas dram shop law. If you were on foot or on a bike, your own auto policy may still cover you. If you were in a rideshare, which insurance applies depends on what the driver’s app showed at that moment.

Cyclists and runners: Allen Parkway and Buffalo Bayou

Buffalo Bayou Park runs between Allen Parkway and Memorial Drive, and the trails bring cyclists and runners to crossings along both roads. Houston’s safe passing ordinance requires drivers to leave at least three feet when passing a cyclist, pedestrian or other vulnerable road user, and six feet for trucks and commercial vehicles. A driver who clipped you while passing did not leave enough room.

The Museum District and METRORail

METRORail’s Red Line runs through the Museum District on Fannin and San Jacinto streets. A crash with a train, or with a METRO bus anywhere in the city, is a claim against a governmental unit. That means the Texas Tort Claims Act applies: notice requirements that run far shorter than two years, and limits on what can be recovered. It is still a real claim, but it has to be handled on a different clock.

River Oaks, and the rest of the Inner Loop

Montrose, the Museum District and River Oaks all lie inside the City of Houston, so the same rules apply across all three: the Houston Police Department works the crash, and a claim involving a city vehicle or a dangerous city-maintained condition requires written, notarized notice within 90 days under the city charter. Injury suits are filed at the Harris County civil courthouse at 201 Caroline, downtown.
